FAIR USE
Parody and "Fair Use"
Some of what appears on this site is parody: a humorous form of commentary and literary parody in which one work imitates another. Parody dates back as far as Greek antiquity.
The question arises whether Copyright Law and Trademark Law prevent or permit parody.
Oh, were the law that simple. You see, it depends.
Copyright law Section 107 provides that "the fair use of a copyrighted work . . . for purposes such as criticism [or] comment . . . is not an infringement . . . ,''. But it requires a case-by-case analysis rather than "bright-line rules".
The U. S. Supreme Court decision in 1994 regarding 2 Live Crew's parody of Roy Orbison's song Pretty Woman was a major ruling in this area. The court established that parody is a defense against copyright infringement claims.
In the case of Trademarks, the law provides some statutory "fair use" protection. But, because it is so narrow, the courts have added three additional categories:
(1) nominative, (2) comparitive advertising and (3) parody.

"A review of trademark parody cases give us no bright line rules. Rather, they appear to be a barometer of both the presiding judge's sense of humor and sense of fairness. As Tom McCarthy puts it, "a non-infringing parody is merely amusing, not confusing."
Bright lines or not, parody does provide some protection and to some extent, depending on the circumstances, parody may permit the use of copyrighted or trademarked material.

Nigerian scammers have become a serious problem on the Internet, targeting all social networks. All new members’ profiles and their ISP connection location are reviewed before being approved. An ISP connection location does not tell us your exact physical address, just a general location. PozVille is an affinity network for HIV poz gay men and our HIV negative friends. An affinity network is a group of people who have an affinity for each other, often sharing specific interest(s) or ideals, know each others strengths and weaknesses, support each other, and or sometimes campaign or work together. What you will discover here are some really cool guys freely expressing what they feel and who they are.
We do not use any freemium social networking services. We purchased our own lifetime license to use the software and the community is hosted on a private dedicated server. The hosting fees are generously donated by “the dingo.”
The community founder and volunteer staff does not operate this private network for profit, we do this in the spirit of giving, sharing, and fellowship. There are no user fees, we don’t ask for donations and no banner ads except for our Amazon affiliate link for those who shop Amazon and want to help offset the hosting fees.
The staff will never ask you for personal info. We only ask for your first name, city, state, date of birth and email address when you register. We do not ask for your last name, mailing address, telephone number, credit card numbers, passwords or any other personal information.
Registration
Signing up under the anonymity of a proxy server is prohibited. Register with an established email account to receive your notifications. GMAIL, Yahoo or a secondary email address you use from your ISP is preferred. Hotmail accounts are not recommended. If your email address is on any blacklist we'll delete your account. Using email accounts from other social networks and "shared hosting accounts" isn't recommended since most won't accept notifications from other social networks.

Duplicate Accounts
The Internet has also become a place where a few think they can behave any way they want without any respect or regard for others' feelings, parameters and boundaries. Don’t create duplicate accounts or use our network to have "multiple personas", play games or engage in prohibited activities, you’ll be caught and blocked - your IP address is exactly the same. Signing up and logging in under the anonymity of a proxy is not allowed and can only mean one thing - you’re trying to hide your real IP address. Give it up, this won’t work either.
You are allowed one user account per lifetime. If you are in a situation where you are going to be sharing an IP address with your room mate, partner, or significant other, let us know before we catch you.
User Names, Content, Boundaries & Parameters
Usernames and first names shouldn't be vulgar, obscene or sexually suggestive. The monikers MACHOMAN DINGO and KEYSMAN may not be used as part of your nickname. Names that may be confused with official staff and mascot names are not allowed.
Usernames and first names that promote any of the following are prohibited: brutal violence, coarse language, domain names and websites, ethno cultural slurs, racial slurs, scatological slang, substance abuse and violence.
Uploading and sharing a limited amount of adult photo content is permitted ONLY within certain areas of the network, mainly in our groups. You may not create new groups or photo album collections for adult content or sex hookups.

Because of Internet escort, scammer and spammer schemes, you are prohibited from making your profile private. Spamming, phishing and scammer activity is on the rise on all social networks. Beware of people who ask you for money, personal information, send you links in private messages or who may ask you to text them on a mobile phone. If it does not seem right, it probably is not. Trust your instinct.
Respect others boundaries and parameters, treat others within this community as if they were guests in your home. Harassment and abusive behavior towards others, privately and publicly, will not be tolerated. Any person who negatively mentions another member publicly will have their profile DELETED without warning.

HATEFUL CONTENT: Users may not publish material that promotes hate toward groups or individuals based on race or ethnic origin, religion, disability, gender, age, veteran status, sexual orientation and gender identity.
VIOLENT CONTENT: Users may not publish direct threats of violence against any person or group of people.
DRUGS: We do not allow anyone to advocate and promote the use of heroin, meth, and cocaine. There are people who use the Internet to do this.
PORNOGRAPHY AND OBSCENITY: Pedophilia, Incest and Bestiality: Users may not publish written, image or video content that promotes pedophilia, incest and bestiality.
Child Pornography: We have zero-tolerance policy against child pornography, and we will terminate and report to the appropriate authorities any user who publishes or distributes child pornography.
Commercial Non Commercial Pornography: We do not allow content that exists for the primary purpose of monetizing porn content or driving traffic to any pornography site.
Advertising & Multilevel Marketing
Using our social network solely for the purpose of doing business for yourself or others is forbidden. We do not allow people to post comments, threads, and infomercials or to send private messages to members that advertise or solicit any products, enterprises, or services. You may not promote your (and others') shopping networks, vacations, paid retreats, dating sites, adult AVS pay sites, adult hookup photo trading groups, affiliate or referral links (including links in your profile and in your signature) or links that lead to click through ads page(s), or post anything asking for a referral. This includes incentives to your affiliate programs, offers for paid sign-ups, redirections to landing pages, luring members to reply directly to you, or any other affiliate related nonsense.
Membership Levels & Upgrades
We do not charge money for upgrades to higher levels. Membership levels are based upon your profiling and other factors. Extending your profiling, your friendliness to others, being active and other factors will get you upgraded to other levels. Upgraded members are not moderated, enjoy additional privileges, perks, receive greater exposure, earn more activity points, receive additional storage and larger size settings for photos, can create multiple albums, do batch uploads and more. Upgrades are at the Staff’s discretion and are not automatic.
Members who fail to log in after 90 days are subject to having their accounts downgraded, deleted or suspended. This reduces the frustrations and wasted time associated with abandoned profiles, which are attributed to email addresses no longer in use by their owners. It is recommended that you LOG IN once a month. This lets us and others know you are still active. Update your registered email address if you make a change to or no longer use the original email address you registered with. If your notifications bounce we will block your access.

Our goals are to share, connect and empower ourselves with other HIV poz gay men who are seeking new friends, experiences, community and just plain fun. There is a little something for just about everyone here. You will find some basics on wellness, relationships, hiv, and more. Visual arts, spirituality, fun, pets, video, music, scifi, fantasy, photos, humor, literature, national issues and politics are the spokes in our wheels.
We encourage everyone to express themselves freely within established guidelines and acceptable social behavior. These guidelines are adapted from some of the best online networks. They're not perfect and not written in stone. Nothing ever is.
The golden rule here is simple. While we may not always agree with each other, we should agree that it's OK to disagree. Within this community respect the rights of others to have their opinions freedom of expressions and beliefs.
